1. Scope

1.1 These General Terms and Conditions (GTC) of Georgios Bobolos, trading under "Ver ò me" (hereinafter "Seller"), apply to all contracts for the delivery of goods, in particular posters and picture frames, which are concluded between the Seller and a consumer or entrepreneur (hereinafter "Customer"). In this case, any deviating terms and conditions of the Customer shall not apply, unless otherwise agreed.

1.2 A consumer within the meaning of these Terms and Conditions is any natural person who concludes a legal transaction for purposes that are neither related to his commercial nor his independent professional activity.

1.3 An entrepreneur within the meaning of these General Terms and Conditions is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her commercial or independent professional activity.

1.4 The seller reserves the right to change these terms and conditions at any time with future effect. Changes do not apply to contracts already concluded.


2. Conclusion of contract

2.1 The product descriptions contained in the seller's online shop do not constitute binding offers. They serve to submit a binding offer by the customer.

2.2 The customer can submit the offer using the seller's order form. By clicking on the final order button, the customer submits a legally binding offer with regard to the goods in the shopping cart.

2.3 The Seller may accept the Customer’s offer within five days by:

  • sends the customer an order confirmation,
  • delivers the ordered goods or
  • asks the customer to pay.

The contract is concluded at the moment one of the above conditions is fulfilled.

2.4 If a payment method is selected via PayPal, the contract becomes legally binding when the customer completes the payment.

2.5 For orders processed via the payment service “Amazon Payments”, the contract is concluded upon completion of the payment order to Amazon.

2.6 The contract text will be saved by the seller and made available to the customer by email after completion of the order.

2.7 The customer can identify and correct input errors before placing the order. The contract can only be concluded in German. If contracts can be concluded in other languages, this will be explicitly stated during the ordering process.

2.8 Order processing is usually carried out via email. The customer is responsible for providing a correct email address and ensuring that he receives emails from the seller.


3. Right of withdrawal

3.1 Consumers generally have a statutory right of withdrawal.

3.2 Exclusion of the right of withdrawal : The right of withdrawal does not apply to goods that have been made according to customer specifications or are clearly tailored to the customer's personal needs, in particular personalized posters or picture frames that are made especially for the customer.

3.3 Further information on the right of withdrawal can be found in the seller’s cancellation policy.


4. Prices and payment terms

4.1 All prices stated in the online shop include statutory VAT. Shipping costs are shown separately.

4.2 The available payment methods will be communicated to the customer in the online shop.

4.3 If you select a payment method via PayPal, Amazon Payments, Stripe, mollie, Ratepay or similar payment service providers, the transaction will be processed in accordance with the terms of use of the respective provider.

4.4 The seller reserves the right to refuse certain payment methods after a credit check.

4.5 The Seller will issue an invoice to the Customer either with the order confirmation or upon delivery of the goods.


5. Delivery and shipping conditions

5.1 The goods will be delivered to the address specified by the customer within the seller’s delivery area.

5.2 No right of return for personalized goods : Personalized products that are manufactured according to customer specifications (such as individually designed posters or picture frames) are excluded from return and cancellation unless there is a defect in the goods.

5.3 If delivery fails for reasons for which the customer is responsible, the customer will bear the resulting costs. In the event of cancellation, the provisions of the cancellation policy apply.

5.4 The risk of accidental loss of the goods passes to the entrepreneur upon handover to the carrier, and to the consumer upon handover to the customer.

5.5 The seller reserves the right to withdraw from the contract if the goods are not available.

5.6 For logistical reasons, it is not possible to collect the goods yourself.

5.7 The average delivery time is 5-7 working days. Any deviations from this will be communicated to the customer in good time.


6. Retention of title

The seller reserves ownership of the delivered goods until full payment has been made.


7. Liability for defects (warranty)

7.1 The statutory provisions on liability for defects apply.

7.2 For contracts with entrepreneurs:

  • the seller has the right to choose the type of subsequent performance,
  • the limitation period for new goods is one year from delivery,
  • Liability for defects in used goods is excluded.

7.3 The limitations of liability do not apply to:

  • claims for damages,
  • fraudulent concealment of defects,
  • Obligation to provide updates for digital products.

7.4 Entrepreneurs must inspect the goods in accordance with Section 377 of the German Commercial Code (HGB) and report any defects.

7.5 Consumers are requested to complain about obvious transport damage to the deliverer and to inform the seller immediately.


8. Applicable Law

The law of the Federal Republic of Germany applies. For consumers, this choice of law only applies if it does not restrict any mandatory provisions of the law of the state in which the consumer has his or her habitual residence.


9. Alternative dispute resolution

9.1 The EU Commission provides a platform for online dispute resolution: https ://ec .europa .eu /consumers /odr .

9.2 The Seller is willing to participate in an out-of-court arbitration procedure.


10. Data Protection

10.1 The seller processes the customer's personal data only to the extent necessary for processing the order and fulfilling the contract. Further information on this can be found in the seller's privacy policy.

10.2 The seller complies with the applicable data protection laws, in particular the GDPR. Without the express consent of the customer, no personal data will be passed on to third parties unless this is necessary to process the contract (e.g. to shipping service providers).


11. Shipping risk and transfer of risk

11.1 For consumers, the risk of accidental loss or accidental deterioration of the goods sold during shipping shall only pass to the customer when the goods are handed over to the customer or a recipient designated by him.

11.2 In the case of entrepreneurs, the risk of accidental loss or accidental deterioration shall pass to the customer upon handover of the goods to the forwarding agent, carrier or other person or institution designated to carry out the shipment.


12. Liability and Damages

12.1 The seller is fully liable for intent and gross negligence. The seller is only liable for simple negligence if essential contractual obligations (cardinal obligations) are violated, the fulfillment of which makes the proper execution of the contract possible in the first place and on whose compliance the customer can regularly rely.

12.2 Liability for damages resulting from injury to life, body or health remains unaffected.

12.3 To the extent that the Seller’s liability is excluded or limited, this shall also apply to the personal liability of employees, representatives and vicarious agents.
